White dwarf supernovae are discovered in Virgo Cluster galaxy and in sky area 'anonymous'

Feb. 27, 2013 ? Light from two massive stars that exploded hundreds of millions of years ago recently reached Earth, and each event was identified as a supernova.

A supernova discovered Feb. 6 exploded about 450 million years ago, said Farley Ferrante, a graduate student at Southern Methodist University, Dallas, who made the initial observation.

The exploding star is in a relatively empty portion of the sky labeled "anonymous" in the faint constellation Canes Venatici. Home to a handful of galaxies, Canes Venatici is near the constellation Ursa Major, best known for the Big Dipper.

A second supernova discovered Nov. 20 exploded about 230 million years ago, said Ferrante, who made the initial observation. That exploding star is in one of the many galaxies of the Virgo constellation.

Both supernovae were spotted with the Robotic Optical Transient Search Experiment's robotic telescope ROTSE3b, which is now operated by SMU graduate students. ROTSE3b is at the McDonald Observatory in the Davis Mountains of West Texas near Fort Davis.

The supernova that exploded about 450 million years ago is officially designated Supernova 2013X. It occurred when life on Earth consisted of creatures in the seas and oceans and along coastlines. Following naming conventions for supernova, Supernova 2013X was nicknamed "Everest" by Govinda Dhungana, an SMU graduate student who participated in the discovery.

The supernova that exploded about 230 million years ago is officially designated Supernova 2012ha. The light from that explosion has been en route to Earth since the Triassic geologic period, when dinosaurs roamed the planet. "That's fairly recent as these explosions go," Ferrante said. Dhungana gave the nickname "Sherpa" to Supernova 2012ha.

Type 1a supernovae help measure cosmic distances

Everest and Sherpa are two of about 200 supernovae discovered worldwide in a given year. Before telescopes, supernovae observations were rare -- sometimes only several every few centuries, according to the scientists.

"Everest and Sherpa aren't noteworthy for being the youngest, oldest, closest, furthest or biggest supernovae ever observed," Ferrante said. "But both, like other supernovae of their kind, are important because they provide us with information for further science."

Everest and Sherpa are Type 1a supernovae, the result of white dwarf explosions, said Robert Kehoe, physics professor and leader of the SMU astronomy team in the SMU Department of Physics.

The scientists explain that a white dwarf is a dying star that has burned up all its energy. It is about as massive as Earth's sun. It's core is about the size of Earth. The core is dense, however, and one teaspoon of it weighs as much as Mount Everest, Kehoe said.

A white dwarf explodes if fusion restarts by tugging material from a nearby star, according to the scientists. The white dwarf grows to about one and a half times the size of the sun. Unable to support its weight, Kehoe said, collapse is rapid, fusion reignites and the white dwarf explodes. The result is a Type 1a supernova.

"We call these Type 1a supernovae standard candles," Ferrante said. "Since Type 1a supernovae begin from this standard process, their intrinsic brightness is very similar. So they become a device by which scientists can measure cosmic distance. From Earth, we measure the light intensity of the exploded star. As star distances from Earth increase, their brilliance diminishes."

While Sherpa is a standard Type 1a, Everest is peculiar. It exhibits the characteristics of a Type 1a called a 1991T, Ferrante said.

"Everest is the result of two white dwarfs that collide, then merge," he said.

The brightness of Sherpa's explosion was a magnitude 16, which is far dimmer than can be seen with the naked eye. Everest's explosion was even dimmer, a magnitude 18.

For perspective, light travels 5.88 trillion miles in a year. The sun is 93 million miles from Earth, so light from the sun reaches Earth in eight minutes.

Supernovae help in search to understand mysterious dark energy

Like other Type 1a supernovae, Everest and Sherpa provide scientists with a tiny piece to the puzzle of one of the greatest mysteries of the universe: What is dark energy?

Every Type 1a supernova provides astronomers with indirect information about dark energy, which makes up 73 percent of the mass-energy in the universe. It's theorized that dark energy explains the accelerating expansion of our universe at various epochs after the Big Bang.

"Every exploding star observed allows astronomers to more precisely calibrate the increasing speed at which our universe is expanding," Ferrante said. "The older the explosion, the farther away, the closer it was to the Big Bang and the better it helps us understand dark energy."

Hobby-Eberly spectrogram confirms discovery of supernovae

Everest's discovery was confirmed by a spectrogram obtained Feb. 10 with the Hobby-Eberly Telescope, also at McDonald Observatory. Everest is located in a host galaxy identified as 2286144 in the Principal Galaxies Catalog.

A spectrogram obtained Nov. 29 with the Hobby-Eberly Telescope confirmed Sherpa's discovery in one of the many galaxies of the Virgo Cluster.

The Central Bureau for Astronomical Telegrams of the International Astronomical Union officially designated the discoveries as Supernova 2013X and Supernova 2012ha.

Ferrante and Dhungana made both discoveries as part of an international collaboration of physicists from nine universities. Everest and Sherpa were discovered with a fully automated, remotely controlled robotic telescope at the University of Texas' McDonald Observatory. The discovery is a first for the SMU collaboration members.

The telescope, ROTSE, constantly scans the skies for any significant changes, such as supernovae, novae and variable stars. Data from the telescope are reviewed daily by Ferrante, Dhungana and other scientists on the team, who search for signs of stellar activity.

Until now, primary responsibility for the management and operation of ROTSE3b was held by the University of Michigan. The SMU team took over that responsibility starting in Fall 2012. The ownership transfer will be completed by summer 2013, said SMU's Kehoe.

Alarming Trend: Kids Are Taught By Teachers Without Credentials

Teaching without the proper credentials is a problem in America.

This is especially true in California, according to new data reported initially by California Watch. The state Commission on Teacher Credentialing?s data showed that from 2007 to 2011, 1 in 10 teachers or certificated personnel didn?t have credentials or authorization for their positions, or about 32,000 school employees.

What does that mean exactly? Teachers who are qualified for biology may have been teaching history. Or English teachers may have been teaching math. In some cases, unqualified teachers teach special needs classes.

While this is a problem now, according to Anne L. Padilla, a consultant with the California Commission on Teacher Credentialing, it used to be worse.

?As the California Watch article points out,? Padilla told TakePart in an email, ?the number of misassignments has dropped dramatically since the 2005-06 school year; from 29 percent to 12 percent when the state began giving greater attention to teacher assignments at low-performing schools. The Commission continues to work with COEs to decrease the number of misassignments in their schools.?

According to Padilla, ?misassignment? is the placement of a certified employee in a teaching or services position for which the employee does not hold an appropriate authorization for the assignment.

The reasons for misassignment varies, according to the report, which states ?staffing turnover and shortages, insufficient resources, poor planning and mismanagement contribute to assigning teachers to classes for which they lack specialized training.?

When this happens, it is the students who suffer.

Teachers need knowledge of the content to create engaging, authentic and academically rigorous learning opportunities.

?It seems reasonable to assume that teachers need knowledge of the content to create engaging, authentic and academically rigorous learning opportunities for students,? Steve D'Agustino, director of Fordham University?s Regional Educational Technology Center told TakePart. ?It's unlikely that a teacher who may be one or two chapters ahead of the students can help them meet the challenges of an increasingly competitive and complex global society.?

California, however, is far from alone with dealing with the misassignment problem.

The National Education Association has reported that ?each year some out-of-field teaching takes place in more than half of all U.S. secondary schools, and each year over one fifth of the public 7th-12th grade teaching force engages in this practice.?

In 2008, The Education Trust reported that low-income students and minority students are about ?twice as likely as other students to be enrolled in core academic classes taught by out-of-field teachers.?

In 2011, the National Center for Education Statistics (NCES) reported that about 30 percent of chemistry and physics teachers in public high schools didn?t major in these fields and didn?t have a certificate to teach the subjects. These are the subjects President Barack Obama has deemed critical to America?s future in a global economy.

In some cases, misassignments may actually be a misnomer.

?Imagine a school district that cannot identify a licensed algebra teacher but they have a science teacher who has some mathematics expertise,? D'Agustino told TakePart. ?Not offering algebra is not an option so they often have no choice but to place the science teacher in that class until a certified teacher can be identified.?

He says to imagine teaching as a competitive market like any other business. In that way, licensed teachers in any subject?math, science, English?is a competitive game.

?So it may be that math teachers can pick and choose where to teach and as a result may elect to teach in more ?desirable? districts?better paying, higher performing,? he said. ?This results in a lack of certified teachers in under-performing areas, exacerbating the poor performance in mathematics.?

Solutions to this problem are controversial and complex.

?Districts cannot pay math teachers more than physical education teachers (for example) even though math teachers might be in greater demand,? he said. ?All teachers, regardless of subject area, are on the same salary scale.?

He suggests that perhaps schools should adopt the university model and use adjuncts as universities do. But that comes with a problem as there are no real mechanisms that allow most schools in the United States this option.

Still, an unqualified teacher in a certain subject is better than no teacher at all.

?This is not to suggest that these misassigned teachers (and the schools for which they work) are operating in bad faith,? D'Agustino adds. ?Rather, they present the best solution to a persistent teacher shortage.?

NEC NP-VE281

Although the NP-VE281 from NEC Display Solutions of America is a decidedly no-frills model, what this inexpensive portable data projector for use in business or school presentations lacks in bells and whistles it makes for in solid data and video image quality and an easily audible sound system.

The NP-VE281 is an off-white projector with rounded corners. It measures 3.2 by 10.9 by 9.7 inches (HWD) and weighs 5.1 pounds, so it's lightweight and quite portable. It lacks a carrying case?a suitable one is available from NEC for $54 (direct). ?

This projector has a native SVGA (800 by 600) resolution, a 4:3 aspect ratio typical of traditional data projectors. It's rated at a fairly bright 2,800 ANSI lumens.

The NP-VE281 has focus and zoom rings behind the lens. At maximum zoom (a mere 1.1:1), it projected an image that filled our test screen, about 50 inches diagonal, from nine feet away, a little farther than usual for a long-throw data projector.

This projector's sparse selection of ports include VGA-in; HDMI; a video-in RCA jack; audio-in, and RS-232. The absence of a port to run presentations off a USB thumb drive means you'll have to lug a computer or other data source with you when you take the NP-VE281 with you on the road.

Data Image Testing
In my testing using the DisplayMate suite, the NP-VE281's image quality was very good for a budget DLP projector, and fine for typical business or classroom presentations. In our type tests, text was readable down to our smallest test sizes, though the small white-on-black type was a little bit blurred. Generally, color was good; some white areas against dark backgrounds showed mild yellow tinting; while yellow swatches appeared a bit mustardy.

The NP-VE281's data images showed traces of the rainbow effect. In this phenomenon, which is exclusive to DLP-based projectors, light areas against dark backgrounds may break down into their component colors to form rainbow glints. People vary in their sensitivity to this effect (I seem to be of average sensitivity). The rainbow effect for this model was typical of today?s DLP projectors, and shouldn't be an issue with data images for the vast majority of viewers.

Video Testing
Video quality was solid for a budget portable DLP projector. There was occasional posterization (abrupt shifts in color where they should be gradual), as well as faint hatching in some backgrounds. The rainbow effect was visible in some scenes that tend to draw it out. It could be a distraction to viewers who are particularly sensitive to it, but shouldn't bother most users. Although I wouldn't want to watch full-length movies with it, the video quality should be fine for short to mid-length clips to accompany a presentation.

Other Issues
To complement the solid video quality, audio from the NP-VE281's 7-watt speaker proved a bright spot, loud enough to fill a small to mid-sized room, and of decent quality. Users shouldn't miss the absence of an audio-out jack to connect to external speakers.?

The NP-VE281 is a barebones data projector, with very good data image and solid video quality for an SVGA projector, and reasonably loud sound. It's a good choice for a businessperson who needs to present on the road to small groups, or a teacher for the occasional classroom presentation. Although small and light enough to be portable, it lacks a carrying case, though one can be bought from NEC. It has a sparse set of connectivity ports, and lacks the ability to run presentations from a USB thumb drive.

The Editors' Choice Epson PowerLite 93+ provides higher (XGA) native resolution at the same 4:3 aspect ratio as the NP-VE281. The 93+ costs and weighs a bit more than the NEC projector, but provides superb data and video image quality, and as an LCD projector it's guaranteed to be free of rainbow artifacts. Its audio is even louder than that of the NP-VE281. The Epson PowerLite S11 Multimedia Projector is an LCD-based SVGA projector with a good feature set and solid data image quality, though it lacks an HDMI port.

Although the NEC NP-VE281 is low resolution and limited in features, this inexpensive data projector delivers where it counts, generating good data image quality, solid video, and fairly loud audio. For many educators and road warriors, that should be more than enough.

(AP) ? Syrian rebels battled government troops near a landmark 12th century mosque in the northern city of Aleppo on Tuesday, while fierce clashes raged around a police academy west of the city, activists said.

The fighting near the Umayyad Mosque in the walled Old City threatened to further damage the historic structure, part of which was burned during clashes last year.

Since July 2012, government forces and rebels seeking to topple President Bashar Assad have been battling over Aleppo, the country's largest city and a major prize in the civil war. While rebels have gradually expanded the amount of turf under their control, seven months of street fighting, airstrikes and shelling have left much of the city, considered one of Syria's most beautiful, in ruins.

The Britain-based Syrian Observatory for Human Rights reported intense clashes with heavy gunfire and explosions near the mosque. Syria's state news agency said "terrorists" had detonated explosives near the building's south wall, causing "material damages."

Assad's regime refers to the opposition as "terrorists."

The mosque, also known as the Great Mosque of Aleppo, sits near a medieval covered market in the Old City, which is a UNESCO World Heritage site. The mosque was heavily damaged in October, 2012, just weeks after a fire gutted the market.

Syria's nearly 2-year-old civil war has left its mark on other gems of the country's rich archaeological and cultural heritage.

At least five of Syria's six World Heritage sites have been damaged in the fighting, according to UNESCO, the U.N.'s cultural agency. Looters have broken into one of the world's best-preserved Crusader castles, Crac des Chevaliers, and ruins in the ancient city of Palmyra have been damaged.

Both rebels and regime forces have turned some of Syria's significant historic sites into bases, including citadels and Turkish bath houses, while thieves have stolen artifacts from archaeological excavations and, to a lesser extent, museums.

To the west of Aleppo, activists reported fresh fighting Tuesday near the police academy that has become a key government military installation.

The Observatory said the two sides were shelling each other's positions while the government launched airstrikes in the area.

Video posted online in recent days shows rebel groups firing homemade rockets and mortars at the academy and blasting it with captured tanks. The videos appeared genuine and corresponded with other Associated Press reporting.

The Observatory said the dead in the last two days of fighting in the area included 26 rebel fighters, 40 soldiers and five pro-government militiamen.

The police academy, which activists say the government has turned into a military base, has recently emerged as a new front in the battle for Aleppo. Losing the facility would hinder the regime's ability to shell opposition areas and support its troops inside the city.

An Aleppo activist who goes by the name Abu al-Hassan said via Skype that rebels coming from Idlib province to the west are now trying to clear the army from residential areas near the academy before they attack it.

"Yesterday and today they have been trying to go forward but there are lots of shelling and airstrikes," he said.

The fighting has largely destroyed Aleppo and caused humanitarian conditions for the city's remaining civilians to plummet.

On Tuesday, Human Rights Watch said more than 141 people, including 71 children, had been killed in at least four missile strikes by the Syrian government in and near the city of Aleppo last week. The New York-based group said the strikes hit residential areas and called them an "escalation of unlawful attacks against Syria's civilian population."

A Human Rights Watch researcher who visited the sites said up to 20 buildings were destroyed in each area hit by a missile. There were no signs of any military targets in the residential districts, located in rebel-held parts of Aleppo and its northern countryside, said Ole Solvang, the researcher.

"The extent of the damage from a single strike, the lack of (military) aircraft in the area at the time, and reports of ballistic missiles being launched from a military base near Damascus overwhelmingly suggest that government forces struck these areas with ballistic missiles," HRW said in its report.

It added that the Aleppo neighborhoods hit were Jabal Badro, Tariq al-Bab and Ard al-Hamra. The fourth strike documented by the group was in Tel Rifat, north of the city.

UNICEF said in a statement that it is "appalled" by the deaths of children, and called on all parties in the conflict to "ensure that civilians ? and children especially ? are protected, at all times."

U.N. political chief Jeffrey Feltman condemned the bombings in Aleppo and Damascus and repeated a call "to immediately end the supply of arms to both sides in this brutal conflict." He pledged that "perpetrators of serious crimes will be held accountable."

Syria has never acknowledged the strikes, and portrays the conflict as a foreign conspiracy carried out by "terrorists" to weaken the country.

The missile attacks have outraged the leaders of Syria's exiled opposition who have accused their Western backers of indifference to the suffering of civilians caught up in the conflict.

Also Tuesday, the Observatory said the death toll in a car bomb attack in Damascus had risen to eight. All were regime security officers, it said.

The blast late Monday struck a security checkpoint in the neighborhood of Qaboun, less than a kilometer (mile) from Abbasid Square, northeast of downtown. It was followed by several other smaller blasts thought to be mortar shells landing in various districts of the capital.

The explosions and subsequent gunfire caused panic among residents who hid in their apartments.

Syria's state news agency said the blast was caused by a suicide car bomber and caused an unspecified number of casualties.

The U.N. says some 70,000 have been killed since Syria's conflict began in March 2011.

Crawford, Shaw stretch Blackhawks' streak to 18

CHICAGO (AP) ? Corey Crawford made 28 saves, and Andrew Shaw scored the only goal as the Chicago Blackhawks stretched their NHL-record, season-opening point streak to 18 games with a 1-0 victory over the Columbus Blue Jackets on Sunday night.

Crawford earned his seventh NHL shutout and second this season in his first start since Feb. 12. He outdueled Columbus' Steve Mason, who stopped 26 shots.

Shaw provided all the offense in the second period for Blackhawks (15-0-3), who haven't lost in regulation time this season and have earned 33 of 36 possible points. Chicago has won nine straight against Columbus, dating to Feb. 18, 2011.

The Blackhawks set the league record with at least one point in the first 17 games of a season when they beat San Jose 2-1 on Friday ? topping the 2006-07 Anaheim Ducks, who started 12-0-4.

Crawford had been sidelined after he sustained an upper-body injury in a 3-2 shootout loss to Anaheim on Feb. 12. Ray Emery started and won four games in his absence.

Crawford returned to the lineup as Emery's backup on Friday.

The 18-game point streak is also a team record for the Blackhawks, who have only lost in shootouts this season.

The Blue Jackets (5-12-2), who have an NHL-low 12 points, went 0-for-5 on the power play. Mason kept the game close.

The Blackhawks dominated territorially and in puck possession through the first two periods, but only managed to get one shot past the Blue Jackets goalie.

Both teams had a handful of scoring chances in the first period. Mason made a point-blank pad save on Marian Hossa with 8:30 left, and Crawford stopped Derick Brassard from the slot two minutes later.

Mason denied Hossa on a breakaway 5:30 into the second after Hossa stole the puck from James Wisniewski at the Columbus blue line.

The Blue Jackets failed to convert several close-in attempts during a power-play late in the second, including when Vinny Prospal's shot hit the crossbar to cap a breakaway.

Shaw finally broke through with 1:27 left in the second from the low edge of the left circle. He took Bryan Bickell's backhanded feed from the back boards and ripped a high one-timed shot that beat Mason high on the stick side.

Mason made a point-blank pad save on Patrick Kane midway through the third period after Kane made a spectacular spin move and cut across the crease alone.

NOTES: The Ducks went on to win the Stanley Cup in 2007. . Blackhawks C Dave Bolland missed the game with an undisclosed upper-body injury. ... Ronda Rousey doesn?t want to even touch the UFC championship belt before fighting

ANAHEIM, Calif. -- When Ronda Rousey was named the UFC women's bantamweight champion, critics said she didn't deserve the belt and that she should have to fight for it. It turns out she agrees with her critics.

"I don't deserve it. I won't even touch it until I win," Rousey said of the gold and leather belt in sitting in front of her on the table.

[Related: Liz Carmouche never planned to be a role model, but now is relishing the job]

After the press conference, Rousey faced off with Liz Carmouche, her opponent at UFC 157 on Saturday. Traditionally, the champion holds the belt during these pictures, but Rousey held true to her word. Finally, UFC president Dana White draped the belt over her shoulder, much to Rousey's dismay.

Rousey's unwillingness to touch the belt isn't alone in sports. In the NHL, teams who win the Eastern and Western conferences usually won't touch the Prince of Wales Trophy or Clarence S. Campbell Bowl, respectively. With the ultimate goal of lifting the Stanley Cup, many players view picking up these trophies as bad luck. The Philadelphia Flyers touched the Wales trophy before ultimately losing to the Chicago Blackhawks in the Stanley Cup finals, proving that Rousey may be on to something.

Start-up Pinterest wins new funding, $2.5 billion valuation

SAN FRANCISCO (Reuters) - Online scrapbook Pinterest has raised a new $200 million round of funding that gives it a valuation of $2.5 billion, the company said on Wednesday.

Pinterest, which allows users to create online bulletin boards based on various themes such as travel, decorating, or sports, said in a statement it would use the new capital to build new features, beef up its infrastructure, and make "strategic acquisitions of both talent and technology."

Long-short hedge fund Valiant led the investment round, joined by existing investors Andreessen Horowitz, Bessemer Venture Partners and FirstMark Capital. Valiant has invested in several consumer-Internet companies in the past, including search engines Google and Baidu.

News of the funding round was first reported by AllThingsD.

Pinterest is part of a group of start-ups that offer twists on Internet networking among various groups. They typically have little discernable profit or revenue, but have landed some outsized investments from venture capitalists.

The group includes private social-network Path, which raised $30 million at a valuation of $250 million last year; question-and-answer site Quora, which raised $50 million at a $400 million valuation last year; and microblogging service Twitter, which raised $400 million in new funding and another $400 million to buy out existing investors at an $8 billion valuation in 2011.

Since Facebook Inc's May initial public offering, which saw the stock fall far below its offer price before rebounding in recent months, many investors have cooled on consumer-focused Internet companies.

But Pinterest's rapid growth since its 2010 launch may make it an exception. It now has 48.7 million users globally, according to consultancy comScore.

The company last raised money in May 2012 at a $1.5 billion valuation in a round led by Japanese e-commerce site Rakuten Inc.

Simple view of gravity does not fully explain the distribution of stars in crowded clusters

Feb. 20, 2013 ? Gravity remains the dominant force on large astronomical scales, but when it comes to stars in young star clusters the dynamics in these crowded environments cannot be simply explained by the pull of gravity.

After analyzing Hubble Space Telescope images of star cluster NGC 1818 in the Large Magellanic Cloud, a satellite galaxy of the Milky Way, researchers at the Kavli Institute for Astronomy and Astrophysics (KIAA) at Peking University in Beijing found more binary star systems toward the periphery of cluster than in the center -- the opposite of what they expected. The surprising distribution of binaries is thought to result from complex interactions among stars within young clusters.

The team's finding will be published in the March 1 print issue of The Astrophysical Journal and is now online.

In the dynamic environment of a star cluster, high-mass stars are thought to gravitate toward the center of a cluster when they give a 'kick' to lower-mass stars and lose energy, explained KIAA Prof. Richard de Grijs, who led the study. This leads them to sink to the cluster center, while the lower-mass stars gain energy and might move to orbits at greater distances from the cluster core. Astronomers call this process "mass segregation."

However, when the Kavli researchers looked closely at binary star systems within NGC 1818, they found a much more complex picture.

Most stars in clusters actually form in pairs, called "binary stars," which initially are located so close to one another that they interact, resulting in the destruction of some binary systems. Other binaries, meanwhile, swap partners. Astronomers had expected that the same process that leads a cluster's most massive stars to gravitate toward the center would also apply to binaries. This is because together, the stars that make up binaries have more mass on average than a single star.

When the astronomers discovered that there were more binaries the farther from the core they observed, they were initially baffled by this unexpected result. They concluded that so-called "soft" binary systems, in which the two stars orbit each other at rather large distances, are destroyed due to close encounters with other stars near the cluster's center. Meanwhile, "hard" binaries, in which the two stars orbit one another at much shorter distances, survive close encounters with other stars much better, all throughout a cluster. This is why more binaries were seen farther out than close in.

Mapping the radial distribution of binary systems in dense star clusters had never been done before for clusters as young as NGC 1818, which is thought to be 15-30 million years old. This is difficult to do in any case, because there are no young clusters nearby in our own Milky Way galaxy. The new result provides new insights into theoretically predicted processes that govern the evolution of star clusters.

"The extremely dynamic interactions among stars in clusters complicates our understanding of gravity," team member Chengyuan Li said. "One needs to investigate the entire physical environment to fully understand what's happening in that environment. Things are usually more complex than they appear."

Judge blocks NYC from Ken Burns film footage

(AP) ? A federal judge on Tuesday blocked New York City from getting footage gathered by documentary filmmaker Ken Burns in research for his movie about the five men exonerated in the Central Park jogger rape case.

U.S. Magistrate Judge Ronald L. Ellis said the city had failed to show him a concern so compelling to trump the "precious rights of freedom of speech and the press" when it last fall requested outtakes and other materials from the film "The Central Park Five."

The request was connected to a $250 million federal lawsuit filed by the men against the city nine years ago after their sentences were vacated. The attack on a 28-year-old investment banker occurred in April 1989, when she was found in the park after being beaten and raped while jogging. She was in a coma for 12 days and was left with permanent damage. The men were exonerated after a man already jailed for other crimes confessed, and DNA evidence supported his claim.

Ellis rejected arguments by the city that Florentine Films and filmmakers Ken Burns, David McMahon and Sarah Burns were not independent journalists entitled to reporter's privilege.

He said Florentine had "established its independence in the making of the film" and may claim the privilege.

He also said the city had failed to adequately address the requirements of relevance and significance of the materials it sought and had failed to demonstrate they are not available from another source.

City attorney Celeste Koeleveld said city lawyers were "disappointed and reviewing our options."

"While journalistic privilege under the law is very important, we firmly believe it did not apply here. This film is a one-sided advocacy piece that depicts the plaintiffs' version of events as undisputed fact. It is our view that we should be able to view the complete interviews, not just those portions that the filmmakers chose to include," the lawyer said in a statement.

Burns said that he and his co-filmmakers are "grateful for this important decision."

"This adds a layer of important protection to journalists and filmmakers everywhere," he said.

His lawyer, John Siegal, called it a "marvelous decision for the media industry generally and documentary filmmakers in particular."

In a declaration submitted to the court in November, Burns called the city's position "deeply disturbing for documentarians and reporters ? and the public at large" and "a troubling attempt to expand the power and role of city government and to reduce the legal protection afforded reporters."

He said the filmmakers made statements after the documentary was made urging the city to settle with the plaintiffs and "close this painful chapter in their lives and the life of the city."

But he said the opinion resulted from the reporting for the film.

"By stating this view, we have not forfeited our journalistic integrity any more than any author or columnist or filmmaker who espouses a point-of-view about a story he or she is reporting," he wrote.

Tim Tebow To Speak At Anti-Semitic Anti-Gay Pastor?s Dallas Church

By dave-dr-gonzo with comments February 19, 2013 00:01

tebow_witnesses_for_jesusThis can?t be good for the popular self-identified Christian quarterback?s image:

[T]he Jets? quarterback has forced his way back into the spotlight with an April 28 speaking appearance at a Dallas megachurch known for its anti-gay, anti-Semitic pastor, Robert Jeffress.

Like Tebow, Jeffress knows how to grab the media spotlight; however, the Dallas pastor prefers public condemnations of other religions rather than relatively mundane quarterback controversies to worm his way into earned media appearances.

In 2011, Jeffress said Mormonism and Islam originated in ?the pit of Hell? and also added that Jews were also ticketed for eternal damnation. A friend of Texas governor and former Presidential candidate Rick Perry, he called Mormonism a cult and told an audience that it should disqualify 2012 GOP candidate Mitt Romney from being President.

Google's Gundotra Promises 'Insanely Great' Nexus Cameras

Nexus 4

Google's engineering chief has promised that the search giant is committed to producing phones with "insanely great cameras."

Vic Gundotra, senior vice president of engineering for Google, made the comment on a Google+ post he penned that questioned whether he should bring a bulky DSLR on an upcoming vacation to Lake Tahoe.

"Tonight, the DSLR won out. I care about shallow depth of field and want to capture photos like the one I've included in this post. I need my Canon 5d with me," he wrote. "So I've decided to dump all the lenses and carry only one. The 50mm 1.2. Let's see how this goes."

In the comments section, someone remarked that "improved sensors in phones will eventually convince you to" skip the DSLR.

Another reader remarked that he hopes to someday "just carry our future Nexus and we won't worry about any heavy camera," before asking Gundotra if that would ever be a possibility.

"We are committed to making Nexus phones insanely great cameras," Gundotra responded. "Just you wait and see."

It should come as no surprise that Google is working to improve the camera on its Nexus phones; it's probably working to improve all the features on its devices. But a powerful camera would be a nice selling point. In his review of the Nexus 4, PCMag's Jamie Lendino found the smartphone's camera to be mediocre.

"In my tests, photo quality was good, though not quite iPhone 5-quality ; outdoor shots looked balanced, but not particularly crisp or detailed," Lendino wrote. "Indoor shots were fairly noise-free, but a little soft in focus."

Video capture, however, was disappointing, he said. "Overall, the camera is an improvement over the Galaxy Nexus , but not enough of one," Lendino concluded.

Gundotra didn't go into any more detail; it was a response to a Google+ post rather than an official product announcement, after all. But we'll likely see something new from Google on the Nexus front at its annual I/O developer conference in May.

The Brotherhood

This is a RP i have done before. Though due to other RL commitments i had to let it go inactive. Now i have a lot more spare time on my hands i am hoping to start it again. with a few new ideas added into it.

The land of Illian is under threat and its people need heroes. An unknown evil from the north has risen and united the creatures of the night. Their attacks grow bolder and more severe with every passing day. A mighty band of warriors has been called upon to try and stop this evil from the north. Isaac the leader of The Brotherhood has sent a summons out across the land for new members.

Just a very basic summary of the RP. Hope to get some interest in this.

U.N. body says U.S. lax on clerical sex abuse cases

VATICAN CITY (Reuters) - A U.N. committee has accused U.S. legal authorities of failing to fully pursue cases of child sex abuse in religious groups, an issue especially troubling the Roman Catholic Church.

The Committee on the Rights of the Child wrote this month that it was "deeply concerned" to find widespread sexual abuse by clerics and staff of religious institutions and "a lack of measures ... to properly investigate cases and prosecute them".

Britain's National Secular Society, which drew attention on Monday to the little-noticed report, said it hoped the Catholic pope to be elected next month would open Church files to help prosecute as yet undiscovered cases of clerical sexual abuse.

The scandal of predator priests has haunted the pontificate of Pope Benedict, who will resign on Feb 28. The pope has apologized for the abuse and met victims in several countries, but cases and damning internal files are still coming to light.

After years of legal battles, the Los Angeles archdiocese bowed to a court order last month and released 12,000 pages of files showing its former head, Cardinal Roger Mahony, had sent accused abusers out of state to avoid justice in the 1980s.

"The committee is deeply concerned at information of sexual abuse committed by clerics and leading members of certain faith-based organizations and religious institutions on a massive and long-term scale," said the report, which gave no details.

It said it also found a "lack of measures taken by (U.S. legal authorities) to properly investigate cases and prosecute those accused" and urged them to order law enforcement officials to step up efforts to uncover and bring charges against abusers.

NEW POPE

The National Secular Society, which campaigns at the United Nations against privileges for religious groups, accused Benedict of hushing up abuse cases and obstructing justice.

"We can only hope that his successor opens the secret files and treats victims with the respect they deserve," its executive director Keith Porteous Ward said in a statement.

The abuse crisis is expected to be among issues cardinals discuss before they enter the Sistine Chapel in mid-March to elect a new pope, but the secrecy of their consultations means it is not clear how much of a role it will play in their choice.

The committee, which drew its conclusions after a routine review of U.S. compliance with the 1989 Convention on the Rights of the Child, adopted its report in Geneva on Feb 1.

The Church and its insurance companies in the United States have already paid more than $2 billion in damages to victims. Clerics from other faiths have also been accused or convicted of sexual abuse of children, but on a lesser scale than Catholics.

Catholic dioceses with known abuser priests have staff files on them and correspondence with the Vatican about some of them. These are confidential but courts and government inquiries in several countries have forced some of them to be opened.

Sexual abuse cases in the Catholic Church began coming to light in the 1980s and became a major crisis in 2002, when U.S. media began reporting systematic cover-ups for abusive priests.

Ireland, Germany, Belgium and the Netherlands have grappled with similar scandals after official or Church-led reports exposed abuse in schools and church organizations.

AWKWARD QUESTIONS

The Church in many countries has set up new guidelines to deal with past abuse, prevent new cases, report abuse to police and stop potential abusers from entering the priesthood.

But campaigners say there is much still to be discovered about how the Church behaved in the past and want more bishops who were aware of abuse to be held responsible.

"Hundreds if not thousands of clerics have wrongly escaped incarceration due to the continuing secrecy of the Church and the issue being almost ignored by law enforcers," Porteous Wood said. "Prosecuting authorities have some very awkward questions to answer, and not just in the U.S."

Boston's Cardinal Bernard Law resigned after scandals were exposed there but was named to a prestigious Church post in Rome. Mahony, who had already retired as Los Angeles archbishop, was stripped of his public ministry when files were opened there.

Victims' groups have tried to establish a legal link between abuse cases in countries such as the United States and Germany and the Vatican, which in some cases appeared more concerned about protecting the Church's image than helping the victims.

Before his election in 2005, Benedict headed the Vatican's doctrinal office and took over handling of sexual abuse cases in 2001. Supporters say Vatican infighting kept him from responding decisively but he took a tougher stand once he was pope.

Critics say he failed to take effective action. "He publicly spoke about the crisis more than his predecessor but that alone is no achievement," SNAP, an abuse victims' advocacy group, said after he announced his resignation on Feb 11.

In 2010, Benedict was named as a defendant in a U.S. law suit alleging that he failed to take action as a cardinal in 1995 when he was allegedly told about a priest who had abused boys at a school for the deaf decades earlier.

The lawyers withdrew the case last year and the Vatican said it was a major victory that proved the pope could not be held liable for the actions of abusive priests in their dioceses.
